Fund-Raiser Instructions

  • How do I get started?
    1. Click on the "Online Filing" button.
    2. Click on the "Register" button in the Mississippi Charities Registered Filer Login box. If the user/third party is already registered in the Charities system, they will use the same log in, and do not need to register again.
    3. Enter data in the text box for verification.
    4. Complete the User contact information and select the "confirm" button.
    5. The system will send a temporary password to the email address entered on the form.
    6. Login with a username (email address entered on form) and the temporary password provided. The User will be able to change the temporary password during the login process.
  • Who should register as a user?
    The contact person of the professional fund-raiser (PFR) or fund-raising counsel (FRC) or third-party filer should complete the user screen for the PFR or FRC. This is the person who will be contacted by the Charities Division for any questions and will receive all updates regarding registrations and filings. This person will need an email address in order to log into the online filing system and will be responsible for the signature verification process once the registration is complete.
  • What is a fund-raising counsel and who needs to file an online application?
    A person
    1. who for a fixed fee or rate under a written agreement plans, manages, advises or consults with respect to the solicitation in this state of contributions by a charitable organization,
    2. who neither solicits contributions nor directly or indirectly employ, procure or engage any person compensated to solicit contributions, and
    3. who does not at any time, whether directly or indirectly, receive or have custody or control of contributions.
  • What is a professional fund-raiser and who needs to file an online application?
    Any person who for compensation or other consideration is retained by a charitable organization to solicit in or from this state contributions for charitable purposes directly or in the form of payment for goods, services or admission to fund-raising events, whether such solicitation is performed personally or through his agents, servants or employees or through agents, servants or employees especially employed by or for a charitable organization who are engaged in the solicitation of contributions, the sale of goods or services or the production of fund-raising events under the direction of such person, or a person who plans, conducts, manages, carries on, advises or consults, whether directly or indirectly, in connection with the solicitation of contributions, sale of goods or services or the production of fund-raising events for or on behalf of any charitable organization, but does not qualify as a fund-raising counsel within the meaning of Sections 79-11-501 through 79-11-529, or who engages in the business of soliciting contributions for such purposes.
  • What is a professional solicitor and who needs to file an online application?
    Any person who is employed or retained for compensation by a professional fund-raiser to solicit contributions for charitable purposes from persons in this state.

Fund-Raising Counsels

  • When should a fund-raising counsel registration be filed?
    All fund-raising counsel registrations expire on June 30th of each year. The annual registration renewal is due by that date.
  • When should a fund-raising contract be filed?
    All contracts entered into between fund-raising counsels and charitable organizations shall be in writing and a true and correct copy of such contract shall be filed by the fund-raising counsel who is a party thereto with the Secretary of State at least ten (10) days prior to the performance by the fund-raising counsel of any service.
  • What should all fund-raising contracts include?
    1. The legal name and address of the charitable organization as registered with the Secretary of State;
    2. A statement of the charitable purpose for which the solicitation campaign is being conducted;
    3. A statement of the respective obligations of the professional fund-raiser or fund-raising counsel and the charitable organization;
    4. A clear statement of the fees or rate which will be paid to the professional fund-raiser or fund-raising counsel;
    5. The effective and termination dates of the contract and the date services will commence with respect to the solicitation in this state of contributions for a charitable organization;
    6. A statement that the fund-raising counsel will not at any time have custody or control of contributions;
    7. A statement for professional fund-raisers that not later than two (2) days after receipt of each contribution, the PFR shall deposit the entire amount of the contribution in an account at a bank or other federally insured financial institution which shall be in the name of the charitable organization with which the professional fund-raiser has contracted;
    8. Any other information required by the rules of the Secretary of State.
  • What do I need to file the Initial Fund-Raising Counsel Application?
    To file an FRC initial online application
    1. The fund-raising counsel’s Employer Identification Number (EIN);
    2. A current list of the fund-raising counsel’s corporate officers, directors, partners, and/or owners of the organization. The list must include full name, address, phone number, and email address;
    3. Signature of President (or other authorized officer). A signature request must be sent electronically. Therefore, an email address for the signer will be required;
    4. Current copies of contracts with charitable organizations;
    5. A $250 filing fee payable with credit card or E-check.


    Please note: The filing will be rejected if the signature verification request does not go to each individual signer at their individual email addresses so that the signatures may be validated.

  • What do I need to file the Renewal for Fund-Raising Counsel?
    To file an FRC renewal online application
    1. The fund-raising counsel’s Employer Identification Number (EIN) or registration number;
    2. A current list of the fund-raising counsel’s corporate officers, directors, partners, and/or owners of the organization. The list must include full name, address, phone number, and email address;
    3. Signature of President (or other authorized officer). A signature request must be sent electronically. Therefore, an email address for the signer will be required;
    4. Current copies of contracts with charitable organizations;
    5. A $250 filing fee payable with credit card or E-check.


    Please note: The filing will be rejected if the signature verification request does not go to each individual signer at their individual email addresses so that the signatures may be validated.

  • What do I need to file a Contract Upload for Fund-Raising Counsel?
    To upload contract(s) for a fund-raising counsel:
    1. The fund-raising counsel’s Employer Identification Number (EIN) or registration number;
    2. Copy of current contract(s) with charitable organizations.

Professional Fund-Raisers

  • When should an online professional fund-raiser registration be filed?
    All professional fund-raiser registrations expire on June 30th of each year. The annual registration renewal is due by that date.
  • When should a solicitation campaign notice be filed?
    All contracts entered into between professional fund-raisers and charitable organizations shall be in writing and a true and correct copy of such contract shall be filed by the professional fund-raiser who is a party thereto with the Secretary of State at least ten (10) days prior to the performance by the professional fund-raiser of any service.

  • When should solicitation campaign summary of financial activities be filed?
    No later than ninety (90) days after the completion of the solicitation campaign and/or on the anniversary date of the commencement of a solicitation campaign lasting more than one (1) year.
  • What do I need to file the Initial Professional Fund-Raiser Application?
    To file an PFR initial online application
    1. The professional fund-raiser’s Employer Identification Number (EIN);
    2. A current list of the professional fund-raiser’s corporate officers, directors, partners, and/or owners of the organization. The list must include full name, address, phone number, and email address;
    3. Signature of President (or other authorized officer). A signature request must be sent electronically. Therefore, an email address for the signer will be required;
    4. Current copies of contracts with charitable organizations soliciting in Mississippi;
    5. Copy of surety bond. The original surety bond should be mailed to the Secretary of State – Mississippi Secretary of State Charities Division, 125 S. Congress Street, Jackson, MS 39201 OR Mississippi Secretary of State Charities Division, Post Office Box 136, Jackson, MS 39205-0136;
    6. A $250 filing fee payable with credit card or E-check.

  • What do I need to file the Renewal for Professional Fund-Raiser?
    To file an PFR renewal online application
    1. The professional fund-raiser’s Employer Identification Number (EIN) or registration number;
    2. A current list of the professional fund-raiser’s corporate officers, directors, partners, and/or owners of the organization. The list must include full name, address, phone number, and email address;
    3. Signature of President (or other authorized officer). A signature request must be sent electronically. Therefore, an email address for the signer will be required.
    4. Current copies of contracts with charitable organizations soliciting in Mississippi;

  • What do I need to file the Solicitation Campaign Notice?
    To file a solicitation campaign notice online:
    1. The professional fund-raiser’s Employer Identification Number (EIN) or registration number;
    2. Copy of current contract with charitable organization;
    3. Copy of all booklets, brochures, bulletins, circulars, scripts, documents, letters, pamphlets, including any articles evidencing a writing which will be used in the solicitation campaign;
    4. Signature from an authorized officer of the professional fund-raiser AND authorized officer of the charity involved in the campaign. Email addresses for both signers are required.

  • What do I need to file the Solicitation Campaign Financial Summary?
    To file a solicitation campaign financial summary online:
    1. The professional fund-raiser’s Employer Identification Number (EIN) or registration number;
    2. The end date of the solicitation campaign for which the summary is being filed;
    3. Signature from an authorized officer of the professional fund-raiser AND authorized officer of the charity involved in the campaign. Email addresses for both signers are required.

  • What do I need to Extend a Solicitation Campaign Notice?
    To extend a solicitation campaign financial summary online:
    1. The professional fund-raiser’s Employer Identification Number (EIN) or registration number;
    2. The new end date of the solicitation campaign;
    3. Copy of contract extension;
    4. Copy of all booklets, brochures, bulletins, circulars, scripts, documents, letters, pamphlets, including any articles evidencing a writing which will be used in the solicitation campaign;
    5. Signature from an authorized officer of the professional fund-raiser AND authorized officer of the charity involved in the campaign. Email addresses for both signers are required.

  • What do I need to file the Professional Solicitor Application?
    To file a professional solicitor application online:
    1. The professional fund-raiser’s Employer Identification Number (EIN) or registration number;
    2. The email address(es) for the professional solicitor(s).
